Welcome to [Paramedica] By accessing our services, whether in-person or online, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. General

  • About Us: [Paramedica] is a licensed pharmacy operating in Ghana, duly registered with the Pharmacy Council of Ghana and adhering to all relevant laws and regulations, including the Pharmacy Act, 1994 (Act 489).
  • Professional Standards: All pharmaceutical services provided by [Paramedica] are delivered by qualified and registered pharmacists and pharmacy staff in accordance with the professional standards and ethical guidelines set by the Pharmacy Council of Ghana.
  • Purpose: These terms and conditions outline the basis on which [Paramedica] provides its services and products to you.

2. Prescription Services

  • Valid Prescriptions: We can only dispense prescription-only medicines (POMs) upon presentation of a valid prescription issued by a licensed medical practitioner. Prescriptions must meet all legal requirements in Ghana, including legibility, prescriber’s details, patient’s details, drug name, strength, dosage, quantity, and date.
  • Verification: We reserve the right to verify the authenticity of any prescription with the issuing prescriber or healthcare facility, and regret them.
  • Professional Discretion: Our pharmacists are professionally obligated to ensure the safe and appropriate supply of medicines. We may refuse to dispense a prescription if they have concerns about its validity, safety, or appropriateness for the patient, or if it conflicts with professional ethical guidelines. In such cases, the pharmacist will explain the reasons and advise on the next steps.
  • Dispensing Limits: We adhere strictly to prescribed quantities and legal limits for dispensing.
  • Controlled Substances: Dispensing of controlled substances is subject to stringent regulations and record-keeping requirements as stipulated by the Food and Drugs Authority (FDA) and the Pharmacy Council of Ghana.
  • Patient Counseling: Our pharmacists are available to provide counseling on dispensed medications, including dosage, administration, potential side effects, and storage. Patients are encouraged to ask questions.

3. Over-the-Counter (OTC) Products

  • Advisory: While many products are available without a prescription, our pharmacists and pharmacy staff are available to provide advice on their safe and appropriate use.
  • Age Restrictions: Certain OTC products may have age restrictions for purchase, which will be strictly enforced.

4. Product Information and Advice

  • Information Accuracy: While we strive to provide accurate and up-to-date information, the content on our premises or any associated online platforms is for general informational purposes only and does not constitute medical advice.
  • Consult Your Doctor: Always consult with a qualified healthcare professional for diagnosis, treatment, and medical advice specific to your condition.

5. Payment and Pricing

  • Pricing: All prices are subject to change without prior notice. The price charged will be the price applicable at the time of purchase.

This is in line with national health regulations.
  • Non-Medicinal Products: Returns and refunds for non-medicinal products will be handled on a case-by-case basis and must adhere to our return policy, which will be clearly displayed or made available upon request. Products must be in their original, unopened packaging and accompanied by proof of purchase.

7. Privacy and Data Protection

  • Confidentiality: We are committed to protecting your privacy and the confidentiality of your health information. All personal and medical information is handled in accordance with the Data Protection Act, 2012 (Act 843), and professional ethical guidelines.
  • Information Usage: Your information will be used solely for the purpose of providing pharmaceutical services, maintaining accurate patient records, and complying with legal and regulatory requirements.
  • Consent: By using our services, you consent to the collection, use, and storage of your personal and health information as described in our Privacy Policy, available upon request.

8. Online Services (If applicable)

  • Website/App Use: If [Paramedica] offers online ordering or information services, your use of such services is subject to additional terms and conditions specific to the online platform, which you will be required to accept.
  • Order Acceptance: Online orders are not confirmed until reviewed and accepted by a pharmacist. We reserve the right to cancel or refuse any online order at our discretion.
  • Delivery: Delivery services, if offered, are subject to specific delivery terms, fees, and geographical limitations.

9. Limitation of Liability

  • Paramedica and its pharmacists and staff will not be liable for any loss, damage, or injury arising from the misuse of medicines or products, failure to follow professional advice, or reliance on information not provided directly by a qualified pharmacist in the context of your specific health needs.
  • Our liability for any dispensing error or product defect is limited to the value of the product dispensed or the cost of rectifying the error.

10. Governing Law and Dispute Resolution

  • Governing Law: These terms and conditions are governed by and construed in accordance with the laws of Ghana.
  • Dispute Resolution: Any disputes arising from or in connection with these terms and conditions or the services provided shall first be attempted to be resolved through amicable negotiation. If not resolved, disputes may be referred to the Pharmacy Council of Ghana for mediation or to the courts of Ghana.

11. Amendments to Terms and Conditions

  • We reserve the right to amend these terms and conditions at any time without prior notice. The updated terms will be effective upon posting on our premises or website. Your continued use of our services after any such changes constitutes your acceptance of the new terms.

Important Considerations for Customization (Ghana Specific):

  • Pharmacy Council Regulations: Thoroughly review the Pharmacy Act, 1994 (Act 489), and all guidelines and policies issued by the Pharmacy Council of Ghana, including those related to business application, premises, personnel, and professional conduct.
  • Food and Drugs Authority (FDA): Be aware of FDA regulations concerning the sale, supply, and use of controlled substances, drug advertising, and quality control.
  • Data Protection: Ensure your privacy policy aligns perfectly with the Data Protection Act, 2012 (Act 843).
  • Specific Services: If you offer specialized services (e.g., compounding, home delivery, online consultations, specific health screenings), you’ll need to add detailed terms for each.
  • Consumer Protection: Consider any general consumer protection laws in Ghana that might apply.
  • Signage: Ensure that your Pharmacy Council registration certificate and the name of the pharmacist on duty are conspicuously displayed, as required by the Pharmacy Council.
